These Terms and Conditions (“Terms”) govern your purchase, access, and use of both our eLearning Courses (“Course,” or “Courses”) and Live Learning Sessions (“Session,” or “Sessions”) offered by Tyfu Learning Ltd (“we,” “us,” or “our”). By purchasing and/or accessing the Course or Session, you agree to these Terms. If you do not agree, you must not proceed with the purchase, access, or use of the service.
1. Access and Service Delivery
1.1 Courses (eLearning - Digital Content)
Upon purchase, you will receive access to the Course via our platform. Access is granted as a non-transferable, perpetual license for the lifetime of the Course. You retain access until the Course is permanently removed or discontinued by us. In such cases, we will provide a minimum of 30 days’ notice prior to removal.
1.2 Sessions (Live Learning - Service)
Sessions are live training events delivered by a qualified trainer via platforms such as Zoom or Microsoft Teams. You will receive a separate confirmation with the date, time, and access link. The service is considered fully performed once the scheduled Session has ended.
1.3 Recording of Sessions
Sessions may be recorded for the sole purpose of internal quality control, addressing conduct issues, or resolving disputes (e.g., verifying complaints of rudeness or unprofessional behaviour). All recordings will be permanently deleted within 14 days of the Session completion. These recordings are not shared with learners or used for future sales.
2. Intellectual Property and Use of Materials
2.1 Ownership
All Course content, including downloadable materials (e.g., .ppsx files), text, images, videos, assessments, and the content of live Sessions (“Materials”) remain the sole property of Tyfu Learning Ltd and are protected by copyright and intellectual property laws.
2.2 Limited Licence
You are granted a limited, non-exclusive, non-transferable licence to access and use the Materials strictly for personal learning and Continuing Professional Development (CPD) purposes only.
2.3 Restrictions on Use
You must not:

Copy, reproduce, modify, or create derivative works from the Materials (digital or recorded).

Distribute, share, upload, or make the Materials available to any third party (including colleagues, friends, or online platforms).

Share your login details or allow others to access the Course or Session through your account.

Use the Materials to create competing courses, training, or content.
Any breach of this clause will result in the immediate and permanent revocation of your access without refund and may lead to legal action.
3. Certificates and Professional Context
3.1 Certificate of Completion
A certificate of completion will be automatically generated once all sections of a Course are completed, or manually issued following a Session.
3.2 Professional Acceptance
The certificate serves as evidence of structured learning and CPD. We are not accredited by any specific external professional body, nor do we guarantee that any regulator or professional body will accept the certificate for credit or license renewal. It is your sole responsibility to confirm acceptance with your relevant professional body or regulator prior to purchase.
4. Refund and Cancellation Policy
This section outlines your statutory rights under UK law, which are in addition to and do not override your rights under the Consumer Rights Act 2015 (CRA 2015) or the Consumer Contracts Regulations 2013 (CCR 2013).
4.1 Statutory Cancellation Right (14-Day Cooling-Off Period)
As your purchase is concluded online (a distance contract), you normally have a 14-day cancellation period, starting from the day after the contract is made, to cancel and receive a full refund.
4.2 Waiver of Cancellation Right (Loss of 14-Day Right)
The 14-day cancellation right is subject to the following statutory waivers for the supply of digital content and services:

For the Course (Digital Content): You lose the right to cancel once you begin accessing or downloading any of the Course Materials. By proceeding with purchase and accessing the Course, you are expressly requesting and consenting to the immediate commencement of the digital content supply and acknowledge the loss of your cancellation right at that point (CCR 2013).

For the Session (Live Service): You lose the right to cancel once the Session has been fully performed (i.e., once the scheduled Session has started and ended, as per Clause 1.2).
4.3 Refunds for Faulty Content or Poor Service (Statutory Rights)
You are entitled to a remedy if the service is not provided with reasonable care and skill (Sessions) or the digital content is not of satisfactory quality, fit for purpose, or as described (Courses) (CRA 2015).

Initial Remedy: We will first offer to re-perform the service (e.g., re-schedule a Session if the original trainer failed to attend) or provide a repaired/updated version of the Course (if materially faulty).

Price Reduction/Refund: If re-performance or repair is impossible or fails to fix a serious breach of standard, you are entitled to a price reduction, which may be up to a full refund.
4.4 Cancellation for Live Sessions (Change of Mind Policy)
If your statutory right to cancel under Clause 4.1 has expired or been lost, the following commercial policy applies to live Sessions:

A full refund will be provided only if you notify us in writing (via email to info@tyfulearning.co.uk) 24 hours or more before the scheduled start time of the Session.

If you cancel less than 24 hours before the start time, or if you fail to attend, no refund will be provided.
4.5 Refund Exclusions
No refund will be provided for:

Subjective dissatisfaction with the trainer's style, design, or content difficulty, provided the service/content meets the standards in Clause 4.3.

Inability to access the Course or Session due to technical issues on your end (e.g., incompatible device, internet failure) where minimum requirements were met by our system.
4.6 Refund Processing
Where a refund is agreed, it will be processed without undue delay and in any event within 14 days of the date on which we agree you are legally entitled to it.
5. Behaviour and Misuse
5.1 Learner Conduct
You agree not to misuse the Course or platform, nor act in a rude, abusive, or disruptive manner during a Session.
5.2 Right to Revoke Access
We reserve the right to suspend or permanently revoke access to the Course or Session without refund if we reasonably believe you have breached these Terms (including Clauses 2.3 and 5.1).
6. Disclaimer and Limitation of Liability
6.1 Educational Use Only
The Course and Session content is provided for educational purposes only (soft skills, fire safety, etc.). It does not constitute legal, financial, or professional advice.
6.2 No Warranties
While we make reasonable efforts to ensure accuracy, we do not warrant that the information provided is complete, up to date, or free from error.
6.3 Limitation of Liability
We do not exclude or limit our liability where it would be unlawful to do so (such as for death or personal injury caused by negligence, fraud, or breach of your statutory rights under the CRA 2015). To the maximum extent permitted by law, Tyfu Learning Ltd will not be liable for any indirect or consequential loss, damage, or expense arising from your use of the Course or Session.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
